  TERMS AND CONDITIONS

1. Definitions and Interpretation

In these Terms & Conditions:

  • “Manager”      means Lincolnshire Property Manager.
  • “Owner”      means the legal owner of the property engaging the Manager.
  • “Property”      means the short-term or holiday-let accommodation managed by the Manager.
  • “Platforms”      means third-party booking platforms including, without limitation, Airbnb      and Booking.com.
  • “Services”      means the holiday-let management services provided by the Manager.

Headings are for convenience only and shall not affect interpretation.

  

2. Scope of Business

2.1 The Manager provides short-term and holiday-let management services only.
2.2 The Manager does not provide long-term residential lettings, AST management, tenancy services, or regulated estate agency services.
2.3 The Manager acts solely as a managing agent and is not the accommodation provider, landlord, or host.

  

3. Acceptance of Terms

3.1 By accessing this website or engaging the Services, the Owner agrees to be bound by these Terms & Conditions.
3.2 These Terms apply to all Services unless otherwise agreed in writing.

  

4. Third-Party Booking Platforms

4.1 The Services operate in conjunction with third-party Platforms, including but not limited to Airbnb and Booking.com.
4.2 All bookings are subject to the applicable Platform’s terms, conditions, policies, and procedures.
4.3 The Owner acknowledges that the Manager has no control over Platform rules, fees, enforcement decisions, outages, or policy changes.
4.4 The Manager shall not be liable for any loss, cancellation, suspension, dispute, chargeback, or enforcement action arising from Platform decisions.

  

5. Order of Precedence

5.1 Where a booking is made via a Platform:

  • (a)      Platform terms govern bookings, payments, cancellations, refunds, guest      conduct, and disputes;
  • (b)      These Terms govern the Services provided by the Manager to the Owner.
        5.2 In the event of conflict, Platform terms shall take precedence in      relation to booking matters.

  

6. Service Packages

6.1 The Manager offers the following holiday-let management packages:

  • Lite      – 10%
  • Standard      – 12%
  • Premium      – 14%

6.2 Services are strictly limited to the package selected and agreed in writing.
6.3 Any services outside the agreed package may be declined or charged separately at the Manager’s discretion.

  

7. Owner Obligations

7.1 The Owner shall remain solely responsible for:

  • Compliance      with all applicable laws and regulations;
  • Fire      safety, gas safety, electrical safety, licensing, and insurance      requirements;
  • Maintenance,      repair, and suitability of the Property for short-term occupation;
  • Compliance      with Platform hosting requirements.

7.2 The Owner warrants that the Property is lawful, safe, and suitable for holiday letting.

  

8. Fees and Payments

8.1 Management fees are calculated as a percentage of gross booking revenue before expenses.
8.2 Third-party costs including cleaning, maintenance, repairs, and consumables are payable by the Owner.
8.3 Late or unpaid fees may result in suspension or termination of Services.
8.4 All fees are exclusive of VAT unless expressly stated otherwise.

  

9. Guest Conduct and Damage

9.1 The Manager does not guarantee guest behaviour.
9.2 The Owner authorises the Manager to pursue deposits or Platform damage claims where available.
9.3 Any damage or loss not recoverable through Platform systems remains the Owner’s responsibility.

  

10. Termination

10.1 Termination by Either Party

Either party may terminate the Services in accordance with any agreed notice period.

10.2 Immediate Termination by the Manager

The Manager may terminate Services immediately where:

  • (a)      Fees remain unpaid;
  • (b)      The Property presents a safety or legal risk;
  • (c)      The Owner breaches these Terms;
  • (d)      Continued management becomes unlawful or impractical.

10.3 Termination by the Owner

The Owner may terminate the Services by providing not less than thirty (30) days’ written notice to the Manager, unless otherwise agreed in writing.

10.4 Consequences of Termination

Upon termination:

  • (a)      The Manager shall be entitled to retain and/or invoice management fees for      all bookings confirmed prior to the termination date, including bookings      occurring after termination;
  • (b)      The Manager shall not be obliged to cancel or amend existing bookings      unless expressly agreed;
  • (c)      The Owner shall remain liable for all outstanding fees, costs, and      expenses incurred up to the termination date;
  • (d)      Access to booking platforms, calendars, and property systems shall be      transferred back to the Owner following settlement of all outstanding      amounts.

10.5 Accrued Rights

Termination shall not affect any rights or obligations accrued prior to termination.

  

11. Limitation of Liability

11.1 To the maximum extent permitted by law, the Manager shall not be liable for:

  • Loss      of income, bookings, profits, or goodwill;
  • Indirect      or consequential losses;
  • Actions,      suspensions, or decisions taken by Platforms.

11.2 The Manager’s total liability shall be limited to the management fees paid in the three (3) months preceding the claim.
11.3 Nothing in these Terms excludes liability for fraud or personal injury caused by negligence.

  

12. Intellectual Property

All website content, branding, text, and materials are the intellectual property of the Manager.
Unauthorised copying or use is prohibited.

  

13. Website Use

The website is provided on an “as is” basis without warranty.
The Manager does not guarantee uninterrupted or error-free access.

  

14. Data Protection

Personal data is processed in accordance with UK GDPR and the Data Protection Act 2018.
Further details are set out in the Privacy Policy.

  

15. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
